Is Marrige certificate needed for incountry dependent appl

Hi,

I will be very thankful if someone could give me an answer.

Is Marriage certificate required for in country Tier2 dependent application, Main applicant is switching from Tier1 to Tier2. Also dependent is applying at the same time as of main applicant.

I will be very thankful.

Yes.

Marital status can change with time.

Thanks alot Rajesh9PL for your reply.

I have gone through the guidance and it is not stating anywhere that marriage certificate is required for leave to remain as dependent.

The reason I am worried is that we have sent marriage certificate to some where else as a proof and will not be expecting it back soon.

Could you please further advise if we submit our applications with out marriage certificate what are the chances of refusal. As we are planning to apply in next few days.

Personally, I agree with rajesh9pl's response.

Don't provide marriage certificate - risk a refusal on that basis.
Provide marriage certificate - no risk of refusal for "not providing evidence of marriage".
Chances of refusal if marriage certificate is not provided - only a caseworker can comment.

One more question when dependent applying with the main applicant and in the same envelop, Do we need to provide:

1. Tenancy agreement
2. Bills
3. Letter from Main applicant for supporting the dependents

I will be thankful for your reply.

Marriage certificate is not required if you've already provided this evidence for previous applications and there is no change in your circumstances.
Your wife is already on your Dependent visa then why would you need to prove it again. Doesnt make any sense to me.

Evidence of relationship is provided for first applications like EC where UKBA has no information about your relationship.

Carefully read the requirements for PBS Dependent eligibility -

Para 319C (h) which states -
(h) An applicant who is applying for leave to remain, must have, or have last been granted, leave:

(i) as the Partner of a Relevant Points Based System Migrant,

(ii) as the spouse or civil partner, unmarried or same-sex partner of a person with leave under another category of these Rules who has since been granted, or is, at the same time, being granted leave to remain as a Relevant Points Based System Migrant, or

(iii) in any other category of these Rules, provided the Relevant Points Based System Migrant has, or is being granted, leave to remain as a Tier 5 (Temporary Worker) Migrant in the creative and sporting subcategory on the basis of having met the requirement at paragraph 245ZQ(b)(ii).

This condition inherently proves your relationship evidence. Dependent cant apply for LTR if above requirement not met.

Rajesh mentioned that Marriage status can change.
Yes true but then you have to tell home office about change of your marital status. In scenario where you dont have good relations with your spouse and then decide to divorce then you have to inform HO about this. Your ex wife has to leave the country. If you decide to marry again your new wife has to take EC first.

We can discuss other scenarios also but i think not relevant for your post.

I discussed with a Senior caseworker for a scenario where Husband+WIfe applied for T1G and then for extension. He confirmed its not required to prove your relationship again for extension. For same reason evidences which remains unchanged like Degrees, english language ability for point scoring are also not required now.

None of these are required because Maintenance attribute will take care of first two questions, and last is not required as both are applying togather.
