ICT Tier 2

ICT Tier 2

I've been offered a job in the UK with my current employer (I am Australian and living and working legally in the Republic of Ireland), and I think I'm eligible to apply for an Intra Company Transfer Tier 2 entry clearance under the Points Based System.

I know that I have to have a Certificate of Sponsorship (my employer has an A rated Sponsor licence), before I apply under Tier 2.

My question is:

Should I have a Restricted or Unrestricted CoS?

Your comments and advice are most welcome.

For ICT category, the concept of restricted / unrestricted CoS does not exist. The concept of unrestricted / restricted CoS applies to Tier 2 (General) category only.

Can you please explain to me why that is? After posting yesterday and having a further look around this site, I found the "TIER 2 OF THE POINTS BASED SYSTEM - STATEMENT OF INTENT, TRANSITIONAL MEASURES AND INDEFINITE LEAVE TO REMAIN" document, which says:

"Tier 2 categories not affected by the limit
• Intra Company Transfers;

CoS for these applications will be known as
‘unrestricted’ and sponsors can issue these CoS
without first applying to the UK Border Agency
for permission."

Does this apply to me?

I'm fairly confused now though!

Why would my employer be telling me that they are not sure if I am eligible for an Unrestricted CoS if it doesn't matter anyway??

Can they just assign a CoS to me regardless?

I get the impression that they have applied for a Restricted CoS and must wait until the 'Allocation Date' before applying under Tier 2 (ICT).

Am I correct in the assumption that a RLMT is not required for a Tier 2 (ICT)?

My employer had to apply for a new Sponsorship Licence for Tier 2 ICT. They've been granted it, so now are applying for a Certificate of Sponsorship for me. Once i have this i can apply for my visa/entry clearance (online).

I'm currently living and working in Ireland - does anyone know if i'm fine to apply for the visa in Ireland, or if i should apply for it in my home country (Australia)?

My employer has waited a while for me, and i want to try and get this sorted as quickly as possible.

Any advice much appreciated!
