Tier 1 Dependent Visa Rejected...Help

Post by serenemind » Sun Jun 05, 2011 1:13 am

Hi All,

My Brother has been living in the UK for the last 6 years. He applied for a dependent visa for his wife to join him in the UK which was refused for the following reasons:

1. Sponsor has not provided a full copy of his passport showing entry and exit stamps to india at the time of the marriage.
2. Satisfactory evidence that the relationship is ongoing has not been provided (He submitted the marriage certificate and a few pictures)
3. The balance in his bank account fell to 438.94 instead of 530 pounds just for 1 day, therefore not maintaining funds for 90 consecutive days.

Now my question is:

Can they appeal this decision as they can provide evidence for the first 2 rejection reasons. And also by June 21st they will have 530 pounds consecutively for 90 days.

If there is no evidence to prove that the required maintenance funds were not available to the applicant on the date of the application or by the date the decision on the application was taken, then appealing the refusal may be futile.
And it is 533 pounds, not 530.

How long have the two been living apart?

7 Months.
I am assuming they have to pay the application fee again right, if they re-apply??

Then it was a mistake not to provide evidence(s) of subsisting relationship. Marriage certificate / marriage photographs are evidence of marriage, not evidence of subsisting marital relationship.

Hi sushdmehta,

May I know what are the actual proofs for subsisting relationship?

I am a Tier1 G holder, currently in UK.
My marriage is fixed a couple of days ago.
Never been in touch with the other person prior to the marriage proposal.
The marriage is planned for middle of July.
I am planning to apply for my dependent's visa after a week of the marriage from India.

Many Thanks.

You need to make sure all your docs are ready in hand. There is a sticky on the main page telling you what documents to complete. I am going to apply for my wife's dependent visa in a couple of weeks but looking through this post, I need to send a copy of entry/exit stamps from my passport :( and a notarized copy of my passport's main pages as well which is a farce. I just go married last month.
