how long can anyone stay abroad- plz help

Hi all,

I am on a tier1 visa valid until 2013 , I initially came on intracompany transfer and changed to Tier 1 general. My company want me to go for off shore job in abroad.
My question is how long I am allowed to stay out side uk to qualify for ILR.
will it affect me in anyway.plz help

Hi Rahul,

You can NOT stay more than 3 months in one single trip. You can NOT stay more than 180 days in 5 years.

I understand that even this 3 months and 6 months allowance comes under exceptional circumstances and needs high level approval. Is there a similar guidance for normal course. Taking my example, I was away for coutniuos period of 45 days to serve my notice period back in home country after getting an offer in UK. This may not be counted in line with annual leaves, business reason and compassionate grounds. Will this be treated as break?

Business trips are not counted in the 3 months limit. When filing ILR, you will need a letter from you employer that you were out of UK on business trips and you were paid full salary during this time.
