Switching from Tier 2(general) to Tier 2(general)

Hi all,

I hope someone will be able to advice me please!

I am currently on a Tier 2 (general) visa from January 2010 and I am eligible for ILR in June 2012 (I was on a work permit before my current Tier 2).

The situation is, I have now been offered a new job and the company is happy to sponsor me on new Tier 2 general visa.

My question is, if I do the switch and move into a new Tier 2 general visa now, will (or potentially could) these new changes regarding settlement affect me and will I then be treated under the "new rules" as stated on the UKBA public consultation document?? Since, obviously my new Tier 2 will be stamped after "6 April 2011".....

if you are making new tier 2 app AFTER april 2011, then yes you will fall under the proposed rule changes

Doesn't this only apply when it's the same employer?

If the OP is switching employers, surely the application would be classed as a new application made after 06 Apr 2011.

firstly, we are only at consultation stage here, so no one can say for sure. However, the consultation refers to migrants who 'entered the UK under the new limit, i.e. since 6th April 2011'

Good point out, as per emphasis on 'entered the UK'. You are right there.

well in that case it's always wise not to make broad statements saying someone will be effected by potential changes.
