Tier 1 (Dependent) Visa Appeal Timelines

Post by ankan.naik » Mon Jun 13, 2011 11:54 am

My wife's (Tier 1 dependent) visa got rejected in Jan this year due to case worker's ignorance regarding the marraige certificate. And we went ahaed with the appeal against the decison in Feb 2011. So far we have not heard any particluar timeline for the decision. Is it possible to apply for a Family visitor visa to bring my wife over to the UK when the appeal is still in process? Or do we have to withdraw the appeal before applying for fresh visa in a different category. Please advise.

You can make a new entry clearance application while the appeal is outstanding (APL 1.20).
This said, whether she will be granted entry clearance as a visitor will depend on whether she fulfils the immigration requirements for a visitor.
Life isn't fair, but you can be!
