Tier 1 Dependent Query - In country now on student visa

Post by rshelar » Wed Jun 29, 2011 3:31 pm

Hi,

I am in the UK on a Tier 1 General visa. My wife is also in the UK but on a student visa.

Can someone please tell me

- If my wife has to apply for Tier 1 dependent can she do it from within the UK by going to PEO or by post? or does she have to go to her home country to do it.

- Is there any difference between Tier 1 dependent and spouse visa? Which one is preferable.

- Can she still study if she is on student visa

- She is also eligible for post study visa. Which one is preferable?

- She has not yet changed her name on any official document. Is that required or can she apply with maiden name?

Thanks.

Thanks for your reply.

But I have seen few posts where people are talking about incountry application for dependent for a baby born or their partner.

Also http://www.bia.homeoffice.gov.uk/workin ... /partners/

does not make mention of it

If your wife was not born in the UK, then the information given in the links you have provided is irrelevant.

Thanks sushdmehta.

No she was not born in the UK and does not have british passport.

So that means she will have to go back and apply for Tier 1 dependent?

She is also finishing her studies soon, will it be worth applying for Post study visa?

Few people have told me they are on spouse visa. Is this the same as a dependent visa?

Can you please point me to link which provides rule for this?

Thanks again.
