IMO, as you have very high absences and also TWO trips of more than 90 days, your chances are very very slim. best you can do is fine a competant solicitor and see if they can help.c0c0nut wrote:Hello,
I am due to apply for my ILR in December this year. I have been working with the same company on Work Permit from the beginning. The nature of my job has led me to be away from the UK for business trips. In summary,
Total Absence : 568 days
Business trips : 484 days
Annual Leave : 84 days
Longest Business trips : 240 days, 118 days
My job is still on the SOC list. I have never broken employment during this period. I have all P60s to show I have been paying tax to HMRC. I also have my employer to support my requirement to be continuously employed here.
I'd like to know what are my chances of success for the ILR application? Alternatively, should I extend my workpermit and apply next year? Any feedback is much appreciated. Thanks!

I don't think so, nor do I think that all caseworkers may even be aware of such decisions which seem to contradict the (basic) internal guidelines on which they may be trained.c0c0nut wrote:sushdmehta
That's helpful, although it does suggest a long drawn-out process of appeals. Do caseworkers now use this as a reference case?
Thanks folks!

Trust everyone had a good Christmas and New Year's break. On this issue, I have extended my WP into Tier 2 - Unrestricted. I would like to know what will the worst case scenario of applying for ILR in the next 6 months? Is there a potential for my ILR to be rejected along with my Tier 2 - Unrestricted revoked? Will the rejection also reset the clock? Kindly share your thoughts. Thanks!
