Advice on ILR

Hi,
I have 2 queries Wondering if anyone can please advice me regarding this.
Issued 1st HSMP on 27 Feb 2007.
Landed: 21 may 2007
Ending : 27/02/2009
Extended for 3 years: 13/02/2009 to 13/02/2012.

Total Visa period = 4years,11months & 14 days - So i am less then 13 days to complete 5 years time period for ILR.

Total Stay period in UK = 4years 9months (approx), So approx. 3 months short for 5 years time period for ILR.

Also my Baby is Born in UK.

My questions are:-

1.) Will HO agree for ILR, as I am short of 5 years stay period by 3 months? - If yes - then please provide me any proof (any link etc)
& if not - then what will be the best step forward in my case?

2.) Also do i have to mention my UK born child on the ILR form or can I apply for his citizenship straigtaway on separate form (then which form it will be? - please guide me ) as he is now 1year+ .

1. As you initially entered within 3 months, I think that you may apply for ILR before your leave expires.
2. No need to include child with your ILR application. Register child for British citizenship after you are granted ILR.

Thanks Vinny for your reply. One more thing Vinny for my ILR i'll be short of 14day ie: original visa ends 27/02/2009 ..extended 13/02/2009 to 13/02/2012..

Sorry for drilling down ..but wants to know shall i go for ilr or extension..your advice is greatly appreciated..
