When did your original work permit entry clearance start?
When does your leave expire?

There is no case where you apply three months before. There is a descrition at ILR stage, given to case worker to consider cases of the applicants with date of entry clearance and date of entry in UK have difference more than 28 days.
The case worker CAN allow the difference of up to 90 days from the date of entry clearance to date of entry in UK. and the period of 28 days is only applicable before you apply for ILR. Meaning you can apply 28 days before your 5 years compeletion for ILR.
The question is... to be or not to be....

Dear guyintheuk,
Is the calculation you made based on that the application can be made 28 days before the 5 years qualifying period?
And my last question:
Do I count the period from the date that I got my passport stamped after Work permit was granted?
Thank you in advance

Is correct.
Shouldn't it be 25/09/11 instead of 24/09/11 considering 28 days. (if it had not been a weekend)

Lets take it to the next level...
If there is a gap of 47 days from entry clearance and entry in the UK. Can we still apply 28 days before the visa expiry. Please write the date in the test case mentioned below;
Date of Entry Clerance : 5 Sep 2007
Entry in UK : 20 Oct 2007
Visa Expiry date : 12 Sep 2012
Latest date to apply for ILR ?????
I am sure many are in the same boat.
Thanks,
The question is... to be or not to be....

Dear vinny,
Would that mean that the qualifying period is based on the entry clearance date and not the Entry in the UK date? My entry clearance was issued on the 20th October 2006 and arrived on the 22nd.

There's
new discretion for some people who entered within three months. You don't need it because you entered within 28 days anyway. The difference for you is two days.
