Financial Information for Evidence in Spouse Visa

Hi there,

I am due to marry my Chinese fiance in November and am currently compiling the information required for supporting documents. I must say that the advice given on these boards are excellent and has given me confidence to submit everything I need despite friends telling me I need to get a lawyer or immigration specialist to do the work for me.

I do, however, have one concern.

While I am in full time employment earning just under £25k a year, I do not have any savings and, more importantly, am half way through an IVA. I can prove that after my monthly outgoings there is roughly £800-£1000 left in my bank account, but will the IVA hinder her application?

We will be living with my parents, a 4-bed semi-detached house and I will get letters of support, survey of the house, etc.

Does anyone have a successful experience with a debt like this? Should I even include details of the IVA?

Hi there,

Just to set you straight and reassure you:

Myself and my husband uased an immigration lawyer to help us compile our documents.

Savings, yes are a bonus, but not a must.

I currently earn £22,500 p/a and have approx £700 left in my account after rent, phone bill etc.

I was told that as long as i have enough each month to support (think its approx £105.00 per week) after all your outgoings, it will be fine.

You can prove that you have more than enough to support your fiance.

With regards to your IVA, i would not worry. I myself are part of a debt managemment program, and my lawyer assured me, this is not a negative. I mean you are not asking for credit are you :lol:

Do provide up to 6 months (original) bank statements, as this will give the ECO a good idea of how you do have enough each month.

One thing i was told to do, was any large sums of money coming in to my account, should be accounted for, for example: i sold my car, so i had £800.00 to put into my account. This is important, as they don't want to see that you have money coming in that could be simply for immigration purposes

The minimum weekly amount remaining after rent or mortgage, council tax and any *loan/credit repayments for a couple is £105.95. You don't need to include other bills and outgoings.
You will need to include the *IVA payments in your calculations.

Yenhau1 - Do you pay your IVA but monthly DD? I pay mine the same each month... I was told that the ECO can see that it is a monthly outgoing and will take this into account when establishing what funds you have left remaining.

Like I say i am simply advising you. Casa's could go into more detail, should you need it.

The point I'm attempting to make (although maybe not that clearly) is that when you calculate how much you have remaining weekly, you will need to deduct from your income; rent or mortgage, council tax and the IVA payments..along with any other credit or loans that you are legally bound to pay.
If finances are weak, it's essential that you set out clearly for the ECO how you will have at least the minimum of £105.95.
