Parent settlement visa

Post by Rahim786 » Thu Aug 11, 2011 11:17 am

Hi, can you plz help
My parents are on visitor visa, my dad is over 65, and my mum is 59, I am planning a visa application for them to join me as dependant parents, can I apply while they are in the uk ??? also my dad is exempt from English language requirement because he is over 65 what about my mum, she is anly 59 does she need to demonstrate the English language requirement or is she also exempt because it will be joint application with my day. I have a all the receipts which I remitted money as a financial help, what about if they have brothers and sisters in their own country, me a sponsor and my brother are settled here in the uk.
Thnx, Rahim

You can not apply for permanent stay for your parents in the UK whilst they are here as visitors. They must return home and apply from there.

The criterias for such visas are very strict, so good luck to you.

The applications can be made from within the UK even though they are switching from visit visas however given that they are here as visitors they may find the application even more difficult.

Elderly dependent relatives
Children and Other dependent relatives
SET08 - Parents, grandparents and other dependants

If they are visiting the UK, then there should also be a change of circumstances if they want to apply for ILR. Else, they may be refused under 322(7) because of 41(i) & (ii).

I am still of the opinion that you should apply for them from their home country, rather than in UK to make the highly improbable task being carried out in the first place a bit easier, than if you applied for them from within the UK
