Eligibility for British Passport

Hi

I am Jaffar Shakir and recently got ILR on 24/8/2011.

My wife was WP and We would be eligible to apply for British Passport next yeat-24/8/2012.

I may have to go out of uk for work commitments and I would like to know can i apply as spouse of british citizen once my wife gets British Passport.

I have stayed in UK for 2 years from May 2002 till August 2004 and I have stayed in uk for 5 years from November 2006 till Aug 2011 and i have less than 40 days in 5 year period.

You cannot apply for a British passport until after you've been granted citizenship.

Thank you for your advice.

For example,if i stay outside uk more than 100 days in last 12 months and I come back to uk after 12 months,do i need to wait again for 12 months more to apply for British Citizenship?

theoretically yes - but UKBA may apply discretion depending upon your total number of days out of UK in the past 5 years and the reasons for absence.

Thank you for your reply before.I hope i meet all requirements and I have family here.home here in uk and if i have only 120 days absence in uk,will this absence be discreted when i apply for british citizenship next year august 2012.

Hi Vinny

I would be grateful to you if you advice me whether i would be eligible to apply for british citizenship if i stay outside uk for 120days as i red somewhere in UK BA Home office website that they disregard absence between 101 to 180 days if we meet all other requirements and if we have home and family in UK.

I have been outside uk around 40 days in last 5 years from November 2006 till now and I have been granted ILR -24th Aug 2011.

You get your British citizenship certificate (or naturalization certificate) only after you are granted British citizenship (i.e after you apply and succuedfuly go through the process including citizenship ceremony)

Once you are a British citizen you can apply for a British passport whenever you wish to. You can also not apply for a British pasport at all.

After you have naturalised as a British citizen, you may work anywhere in the world - in accordance with the immigration laws of the country you intend to work in.

Future intentions requirement may be an issue if you are not married to a British citizen.

Residential requirements may be an issue.

Thank you for your reply.I have stayed only 45 out of uk in last 5 years and I am planing to apply for jobs in middle east and may move to middle east in may 2012 if i get the job.

One question is if I submit as Joint application with my wife and can i request HO to consider my application once they issue BC for my wife and i should still satisfy the requirement that i should not stay more than 90 days outside uk.

I don't think you should have a problem applying as a joint application with your wife (no need to ask for your wife to be considered first). The HO most likely will apply discretion if you absences will be over 90 days.

Wait and see if you get the job and then try to minimise the days out of country as much as you can.

Thank you for your reply.I will try to keep my absence minimum and I have established home here in uk with wife and son staying here back and just applied for my daughter uk passport as she was born here 2 months ago.

I have been only 40 outside uk from nov 2006 till now and I know last one year is very crucial.

Hi Jambo and other senior members

Happy New year to you all.I received job offer to work as Dentist in UAE and Qatar.I really respect your advice.

I have two options
1.Dont process work visa for uae till aug 2012 and apply for citizenship and then get work visa
2.Get work visa and work in uae from June 2012 and come in aug and apply for citizenship and i will have only 70 days outside uk in final year and apply along with wife.

I have doubt about future intention and Can i write letter saying that my wife works here in uk,my son studying here and my daughter holding british passport stays here.will that help.

I am really worried about future intention?

How long is the job for? Could it presented as a training/learning period which will improve your career later in the UK such as learning special dental practices.

It's difficult to advise you what the caseworker would decide as we don't have a full picture of all your circumstances. You have the two options. It's your call. How important is it for you to become BC this year? I guess the money earned from moving in June would be more than the application fee you lose if refused.
