Approved Naturalisation application

Hi there, Kindly advise me on this issue, if citizenship application is approved but the Department of Justice sends another letter regarding alleged suspected criminal STRUCK OUT cases.

How do you comment on these please? Need urgent answers.

An applicant is approved already and then they receive another letter regarding struck out criminal charges? Is the letter came from citizenship section? If the charges are struck out then that is probably the reason that applicant is approved. Could you explain it in more details.

This friend was Deported in 2005, he came back to the UK in 2006, now lives in Northern Ireland married to an Irish national with wife and Irish children, Because Northern Ireland is part of Island of Ireland He is entitled to apply for Irish citizenship based on his legal status in Northern Ireland.

However the reason why deportation happened was because of suspected criminal cases but Gardai struck cases out in order to aid deportaton. At the moment there is an existing deportation order still on his name. When criminal checks are been made in his name it shows there are none because this person hasn't commited any crimes either in the UK or Ireland perhaps not withstanding the revoked criminal convictions.

Please how do you comment on this, after citizenship application is been approved and you have been invited to the ceremony and you get a letter to comment on a struck out case?

i am not sure about that but you can check www.mrci.ie or www.immigrantcouncil.ie. make appointment they will tell you everything immigrant council in dublin is very good.also it is free of charge and confidentails

Was your friend deported from Ireland or the UK? Either way, from what you are saying, he has not had residency in Ireland at any point other than Northern Ireland which does not count. From what you have said, he should have been rejected immediately for not meeting the residency criteria. If he has a deportation order against him in Ireland, he would not be able to meet the residency requirement so he won't be able to obtain citizenship in Ireland until this is removed. If he has been offered to go to ceremony, I have to presume that a mistake has been made and that the offer will be revoked.

The Citizenship offer can easily be revoked by the Minister.

I would suggest a solicitor would be your best bet to sort this out.

He has a deportation order on his file from Irish authorities regardless of there is any criminal charges or not. For foreign nationals usually gardai struck the cases out to facilitate GNIB to deport this does not mean that the file for the person is clean. It does not happen if the offense is minor. You mention in your post that your friend is approved and invited for the ceremony that is surprising there must be a mistake made by INIS. Consult a solicitor as previous posters suggested.

My friend used to live in Ireland but has EU residence card in Northern Ireland. The solicitor has been fighting to revoke the deportation order in his name based on current Zambrano case and irish born children. There is a solution somewhere I hope?
