398 days work. ILR Possibility-applying 4 mths after 5 year?

Post by parsun » Fri Sep 16, 2011 9:15 am

Dear Boarders,

I am considering about applying for my ILR and am seeking your opinion and guidance on my case. My case summary is as follows.

1. Granted UK Entry Clearance in India on 07-Apr-06 and "Entered UK" on 07-May-06 as a WP holder
2. Switched to Tier 1 (General) in 2008 and have also got an extension till 2013.
3. I started my own limited company in Jul'09 and am the director of the company.
4. In Jul'10, my client in UK wanted me travelling to India for work in their offshore centre. The payment for my services was agreed to continue the same as before, ie. invoiced to my UK Limited company in GBP. It has worked the same way till date and I have taken salary from my limited company along with prompt payment of NI and Tax.
5. I have since then worked in India and have travelled back to UK only for certain important meetings and senior management updates. This has resulted in me staying more than 180 days in total and also 2 instances where I had stayed more than 90 days in total. The leave summary is as follows.

2006 - 4 days paid leave
2007 - 10 days (3+7) paid leave
2008 - 32 days Unpaid leave
2009 - 22 days (5+7+15) paid leave
2010 - 19 days (4+7+8) paid leave
158 days (21+77+60) on Work
2011 - 242 days (38+50+154) on Work till date

Note. The leave taken in late 2010 and early 2011 of 60 and 38 days amount to consecutive 98 days of absence.

My queries are as follows.

1. I am considering to show earnings assessment from Jul'10 till Jun'11, the period when I started working outside UK. I guess this would fit into the consecutive 12 month period within 15 months from the date of application.
2. Since I entered UK in May'06, would it be wrong if only my absences till May'11 is counted eventhough I have remained overseas after this period and I may apply in Sep'11?
3. With regards to the document proofs, in addtion to the standard proofs such as bank statements, P60, auditor's letter, pay slips etc., can I also request a letter from my client vouching that my limited company has been engaged to work in their offshore centre in India for a certain time period and I have been providing services since then. I am worried that my client may mistakenly think that I have got visa issues.

Warm Regards,
Parsun.

Parsun,

Aprox. 1-2 weeks before, there was a post here, where ILR has been granted for no. of days out of UK, on 424 days & 544 days also.

Hope your case should be fine as well.
