Cohabitation document for dependent

Cohabitation document for dependent

I am applying for ILR in Oct under 5 year work permit along with my dependent .
As per the new rules dependent should show 2 years stay in UK.
1) Is the 2 year stay is continuous stay ?
2) or total 2 years in 5 years.

My wife stay in UK is for 2 years 10 month.
she joined me on Dec 2007 and with me Nov 2008 and went for pregnancy.
joined me back in UK with our baby on Dec 2009 - ans residing with me in UK till date.

if the 2 year stay is continuous then she is short of 2 month i.e. her continuous stay is 1 year 10 month otherwise her stay is 2 year 10 month.

Regarding cohabitation document on my wife name,
1) Pregnancy check hospital document and other NHS document (letter since 2008)
2) NHS cards (Dec 2007 - Nov 2008) and (Dec 2009 - till date)
3) Voting register letter (2009 - 2011)
4) Council tax bill (Dec 2007 - Nov 2008) and (April 2011 - till date). For Dec 2009 - to April 2011 i don't have the bill , i requested council to generate but due to change in their system they couldn't generate it.
5) NI letter from home office (Feb 2008)
6) ICICI bank statement (march 2008) we closed the account

Are the above documents are sufficient or do i have to arrange some other document then please let me know.

It would be great help to me if any could please respond to me queries

I just confirmed from UKBA that 2 year cohabitation document for dependent are required for only those who are on TIER 2 and not for those on old 5 year work permit.
Did any one of you got similar answer from UKBA?

As per law, dependants of both WP migrants and HSMP JR covered migrants are not subject to the "2 years residence" requirement. So such applicants should not be asked for cohabitation documents.

That said, there have been cases (also posted on the forum) where dependants of HSMP JR covered migrants have been refused settlement for not meeting this requirement.

Your choice, if you wish to include evidence(s) of cohabitation to prove something that such dependants are not subject to .. or not include them.

Thanks for your suggestion. I will be including the cohabitation documents with my application just wanted to check whether the document stated above are sufficient enough.
