Jan 2011 wife's spouse visa denied (UKBA overseas).

June 2011 appeal (in UK)

July 2011 Determination allowed appeal on Human Rights grounds only.

Sept. 2011 wife visits overseas post to ask why she had not been called to give her passport: 'Determination not received at post'.

Oct. 2011 still nothing.

This is well over the 12 weeks they had forward the determination.

I am concerned as I have read that appeals allowed on HR grounds ONLY are an automatic referral to 'Referred Casework Unit'. Does anyone know if this is within the timeframe of the 28 days allowed for the HO to appeal the allowance or is it when the determination is sent to the Embassy/UKBA overseas?

My wife joined me in November.

After an investigation the Home Office admitted that the SAT team had overlooked the judge's determination.

They indirectly confirmed that my wife's visa could have been cleared for issue in July 2011.

They did not mention if the British Embassy in Bangkok had chased the application up. It would seem that the Embassy did nothing despite them requesting the determination is the official procedure.

My MP has said that they will support a letter of complaint possibly leading to an official complaint to the ombudsman.
