ILR date

Hi,

I am bit confused if ILR 28 days qualifying rule will apply in below case:

Entered UK on 1 year WP: 29th Nov 2006
5 year WP Extended & FLR: 17th Sept 2007
Current Leave Expiry: 17th Sept 2012

I will be completing my five years in UK on 29th Nov 2011.

Could I apply for same day PEO service on 1st Nov 2011 (based on 28 days rules) even though my current leave is valid through 16th September 2012?
