Apply Early with KOL REQ. endorsement?

Is the KOL req. endorsement still enforced? Does it still entitle me to apply before the usual 28 day before expiration? Can I apply now as I am planning to?

I have been in the UK since June 2010. My spouse visa which was issued April 6 2010 has the (KOL req) endorsement on it (as my British husband and I have been married over 4 years and living outside of the UK).

I have passed the life in the UK test and want to apply for permanent residence now. I have reviewed the SET(M) and think I know all the documents I need to supply.
