Tier 2 (General) to ILR

Hi there,

Just wanted to get some information with regards to tier 2. I have had an interview and guess that the company is wishing to offer me a position. I was on the work permit since July 2007 and in October 2009 changed to Tier 2 because of change in responsibilities. Now my question is

Q1). With the current existing rules if I change my employer will I be eligible to apply for ILR in June 2012.

Q2). and if the new rules are applied from next year say April 2012 (according to the govt consultation and MAC report on 4th November) will I be counted as a new applicant though I have a work permit and a Tier 2 in the past. I am referring to the April 2011 visa cases i.e. As the govt consultation mentions that these will be applied to the people entering aprill 2011.

rules will be applied to whoever made tier 2 app from april 2011 onwards!!

Hi Arsenal,

Thanks very much fr your answer. Just want to clear onething. Technically I will be applying for a Tier 2 (Gen) application in 2012 is that counted as a new application. I mean to say will I be counted off the limit for Tier 2 visas. Please clarify. Many thanks.

if you need to apply for tier 2, anytime after april 2011, then yes you will be subjected to new rules

Could you clarify please. My entry to clearance to UK is a Work Permit in 2008 and then moved on to Tier 2 ICT in 2010. If I "now" switch to Tier 2 General, do I lose my eligibility for ILR in 2013 on completion of 5 yrs? though my latest Tier 2 General visa application is from within the UK.

1. Under current rules, yes.
2. How do you expect forum members to know the answer(s) to question(s) which, as on date, even the immigration policy strategists may still only be thinking about. Such questions can only elicit "assumptions and speculations"!

This could well be applied from a later date, isnt it? i remember, UKBA told that they would stop psw from 2011 April, which was later extended 1 more year, so I hope that they do the same in this Tier 2-ILR situation as well.

You may be right but could you explain on that, what I tried to say there is its not yet set in concrete, and changes may be there (favourably- although unlikely) than what was suggested on that consultation, would be implemented.
