OK, here is the question which I hope makes everyone's brain work a bit harder.

Case study:

Visa national arrived in UK on 18.September 2006 on a student visa. One of the conditions on the visas sticker was to register with police within 7 days of arrival. The person did not register until 11. October 2006.

Currently, the same person is back in his home country going to apply for new visa as a tier 1 entrepreneur migrant, but as he just has found out that he might be banned from UK for 12 months for his failure to register with the police on time back in 2006.


Would this amount to an automatic 12 months ban or is there discretion that the ECO can apply in this case, taking into consideration this was a minor breach and the person did register as soon as he realized.

Note: the person was 19 years old at the time when he first time arrived in UK. He did not understand the meaning of the conditions on his visa sticker. In addition, back in 2006 such late registration would be considered favourably at the next entry clearance application had the applicant come clean about it on the application form.

Are there any legal cases where this was challenged since 2008 when the new rules were intruduced.

Police is not mentioned in General Grounds, however it is certain that if you are not registered at all, you will be refused extension is police registration was required in visa.

Can you please advise or send links on how late police registration affects extensions?
