SET (M) or FLR(M)

Post by Dino99 » Fri Dec 16, 2011 9:09 pm

Hi,

Here is situation and & my queries ...

I hold Tier-2 G valid till Feb,13.
My wife hold Dependent of Tier-2 G start Dec,10 to Feb,13.

I will be applying ILR on the basis of 10 years on Feb,12.

After that what should I do with my wife visa, which one will be the best option and right to do as per your expertise opinion :-

Option 1: Can she remain on Tier-2 G visa and apply for SET(M) on Dec,12 when she qualify 2 years for that. This way I can save money not applying FLR(M).

Option 2: Or she should switch to FLR(M) asap I got the ILR.

Will appreciate your advice.

Thank you
DINO

Option 2.

Any children in your household also have visas? If so, where were the children born? In the UK, or outside the UK?

Thanks John for your reply,

No, don't have any kids.

So as per your opinion can my wife apply for SET(M) on DEC,12 when she qualify 2 years combination of Dep. T-2 G and FLR(M).

Under current rules, yes (287(a)(i)(d)).
