UK driving offense

Post by bikramyogi » Mon Jan 02, 2012 4:55 am

Hi everyone Merry Christmas and a Happy new Year to all!

I hope someone can give me an information with regards to my problem. I finished my degree in UK on Feb 16 of this year and I need to submit my application for PSW asap before it reaches 12 months from date of award. I had a driving offense in UK back in 2009 for driving without license in which I paid a fine of 350 pounds.. It was an automated payment system so I didnt have any receipt or proof that I have paid it. I only have with me the letter from the court containing my offense and information about it.

Im here in the Philippines and I'm bombarded with a lot of immigration consultants and Im a little bit skeptical about them as their services are really expensive. I hope someone will have a good heart to answer my questions as I'm getting frustrated and pressured with my application. I want to process application on my own but Im too worried about my record back in UK. thanks!

1. What are the chances of a visa being refused if you have a driving offense while I was a student in UK?

2.Do I need an immigration specialist to help me out with my application given that I had a driving offense back in UK?

3.Do I need to declare it on the application form?

4.I only have 30 days to process everything and if they require supporting documents from UK it may take forever how will I go about it?

5.Should I just process my application on my own and declare that I had a driving offense and just provide the summon letter from the court as a supporting document?

I really do hope someone can help me out I will greatly appreciate. :-)

1. Quite big if you decide NOT to declare it and they find out. It happened to somebody in this forum once (exactly the same case), he got refused.

2. No, just state the truth and also put covering letter to explain everything along with some documentation regarding the event. However, if you're not confident enough then maybe its better to hire someone to help you out. Can save all the worries and stress.

3. Yes.

4.

5. +the covering letter.

I hope this helps. It's just a minor thing and its always better to be honest to them.. I am sure you will get your visa if you fulfill all the requirements. Don't worry too much :D

they dont necessarily require evidence of your traffic offence.

they only want you to be honest in your app so declaring the offence would suffice!

of coutse, any documentary evidence will clear the doubts from caseworker's mind

wow thanks for the response it has relieved my worries a lot.. its not easy seeking advise from immigration specialists as they cost a lot when in fact i can apply on my own. some of them have unnecessary fees and hidden charges like one of them who contacted me saying I should pay Php 100,000 (1,500 pounds) that includes visa fee and processing fee to speed up my application process. i think its crazy.

i have one query though, i have paid off my fine for the driving offense do i need to produce a document stating the amount has been paid off? because if i need that document i will still have to request in UK and it may take forever before they can provide me document. im wondering if they will be able to find out if the fine has been settled even if i will only provide them the letter from the court containing the offense? thanks again that's the only thing that's bothering me now and if anyone can provide me info then im good to go :-) thanks a lot!

ukba deals with immigration applications. its not their problem whether you have paid your debt/fines or not!

its always helpful to know their is no outstanding fines etc. but i personally dont think its an issue here especially when you say you have already paid it. you are not required to submit evidence of paymewnt of fine as a part of your psw application so you are all good

hi thanks for the response. its always helpful to hear a clarification from anyone out here. so i guess im all good with my application i was just worried because they're pretty strict nowadays if you have any form of record in UK.

my date of award if Feb 16, 2011.. i heard that i will need to have the visa results before Feb 16 this year.. is that true? or do i just need to submit my papers before Feb 16.. im a bit confused as im checking my timetable for my application .. thanks hoping for answers! :-)

your date of application must be before 16 Feb 2012 - ideally in January really so that caseworker dont have to count 365 days!

you cant predict how long they will take to decide your app!
