Dependents ILR . Help required

Post by iurm28 » Thu Jan 12, 2012 3:40 pm

Hi
I am on ILR and my partner has just completed her 2 years in UK.
She is here as a dependent of Tier 1 holder. Because i recently switched from Tier 1 to ILR .

My wife could not apply with me as she was short of 4/5 months in completion of her 2 years.

I have to apply for yer ILR now.

My question is which form will i use.
I was looking at SET O , but i am not sure if that is the right form because this form does not specify if it is for dependents only.

secondly what is the fee fro that application and time taken by Home office.

your help will be appreciated

I believe that she should switch to FLR(M) prior to applying for SET(M).

She first needs to switch to FLR(M) and then immediately she can apply for ILR using SET(M) form. She would be entitled to ILR under section 287(d).
I hope this helps.
