Hello Guys,

I have been working for my employer for over 18 months(While on PSW) with a salary of 26k which fits the code i am applying for.

My Employer has applied for sponsorship in mid december and got it by early Jan and has been allocated 6 Unrestricted CoS.

But my HR manager claims we need Restricted CoS .


I have already Told Her as far i have read Restricted CoS is only people outside the country. and as i am making an incountry application i would need Unrestricted CoS.

Can anyone please clarify.

You are in country so you need unrestricted COS.

My HR is of the opinion that since this occupation can be filled by anyone it should be a restricted CoS :(

The Occupation Code i am using is J3131 does that matter.

Some facts,

You are currently on PSW
You want to switch to TIER2 General
You are working for the company for the past 18 months
Rule says that if you work for your company for the last 6 months while on PSW you are exempted from a resident labour market test.
If your HR assigns you with a RCOS then they will lose the license (It's mentioned in the Guidelines)

I think you should get a copy of the Guidelines to your "HR manager" he seems to be clueless.

Your occupation code is irrelevant here. Make sure it satisfies the salary for your job title.

As you are having PSW you can apply for Tier 2 and therefore you need Unrestricted CoS..

Thanks guys feel more confident about it now,

i had read the policy guidance numerous times but wasnt sure as the HR manager was confident I need a restricted.
