My Immigration status if Tier 1 extn refused

Post by arnie365 » Thu Jan 19, 2012 3:08 pm

What is my immigration status -
1. if my visa expires while my Tier1 extension is in process at UKBA?
2. if my visa expires while my Tier1 extension is in process at UKBA and I then get a decision that extension has been refused?
2.1 How much time would I be given to leave UK from the date of refusal?
2.2 How much time would I be given to make an appeal from the date of refusal?

Your status is the same as when you had a valid visa and during this period Section 3C of the Immigration ACT 1971 applies to you

2. if my visa expires while my Tier1 extension is in process at UKBA and I then get a decision that extension has been refused?

You would have a 28 day period to apply for an appeal.

2.1 How much time would I be given to leave UK from the date of refusal?

You typically have 15 days - 1 month in case the appeal is also rejected.

2.2 How much time would I be given to make an appeal from the date of refusal?

You would have a 28 day period to apply for an appeal. While in appeal, Section 3D of the Immigration ACT 1971 applies to you

QuickSam, are you sure about the 28 days bit ?

This UK BA page says its only for out of country applications(for dependants):

http://www.ukba.homeoffice.gov.uk/visas ... s/#header1

I remember having read in this forum that for in-country extension applications you are typically given 10 days to appeal.
