Switching from Tier 1 Post-study work

Post by anush » Mon Jan 23, 2012 11:33 pm

Will really appreciate knowledgable advice on this.
I was refused a Tier 2 General, when appliying from UK. To make another application, I will have to apply from my country of residence. However, on my previous application I claimed maintenance funds on basis of switching from Post-Study work category. Other than that, I will not be able to claim these points, but my post-study work visa was expired while Home office was considering my first application. Question - can i still claim these points if post-study's expired?

Thank you!

switching refers to in country applications only. You cannot score points 30 for a certificate of sponsorship on the basis tof PSW if you are applying from outside of the UK. See para 97 of the tier 2 policy guidance. The same applies for scoring points for maintenance, see para 151.

You could ask your employer to check "Maintaining funds on behalf of the migrant" in the COS. Not sure if this can be done applying outside the country on a RCOS.

But worth a try :)
In three words I can sum up everything I've learned about life: it goes on :)

yes but this doesn't solve the problem of scoring points for the Certificate of Sponsorship.

Mate may I ask on what grounds your visa was rejected?

Just to let you know its gonna be a lot harder to get a sponsored visa when you apply from your homecountry as a lot of criteria need to be met.
