Divorce before expiry of spouse visa

Post by nyamekye » Sun Feb 05, 2012 9:19 pm

Hi y'all

i'm asking this on behalf of my sister. she got married to an EEA national in 2005. In 2007 on 27th feb she was granted a 5 year spouse visa. in july last year she divorced her husband. can she be able to apply for an ILR and if so what documents will she require?

Topic moved to appropriate forum.

If your sister can prove that her spouse was a qualified person from 2005-2010,then she will qualify for PR. Alternatively she will need to show that the EEA spouse was a qualified person or exercising treaty rights until divorce was finalised in 2011 and since that period she has been residing in the UK as if she is an EEA national exercising treaty rights
