Biometric Appointment Letters

Hi,

A friend posted his application in Jan 2012 and hasn't received his Biometric Appointment letter yet. Just wanted to check if anybody else has received the Biometric letter after posting the application in Jan 2012.

Please let me know the application posting date and the Biometric Letter date.

He posted it on 6th Jan.

I know it could take up to 6 weeks but this person has been giving me a hard time over the phone. So just wanted to check if someone else has already got a letter.

but even if someone else had got the letter, it is not a significant delay and he needs to wait - tell him to stop giving you a hard time about something you have no control over!!

His point is, someone else submitted at the same time and got a letter and he didn't.

and? not all applications are treated in exaclty the same timeframes - maybe he paid by a different method of payment, or maybe his application has been allocated to a different workflow team. He needs to wait - there is no magic answer here.

I have received the biometric letter.

After receiving the biometric, for booking the appointment, from the drop down do we need to select Tier1 G,

Hi Greenie...technically ukba are supposed to send the bio invitation letter in 2 weeKs time after the application date, isn't it? There have been significant delay this time around..wondering some applicants whose visa expires waiting for the letter and later on they come to know their application is rejected as invalid what option do they have then? Specially if one still waits 28 days of a decision/ biometric inv. letter after their expiration of visa.

no, they have no set timeframes for sending the biometric letter.

Biometric letter is not a sign of approval in any way. You application is processed once you get the Biometric done. The decision might take 4 weeks after submitting biometrics.

Once a decision is made, you would receive the correspondence back within a week to 10 days. In case there is a rejection, you have 28 days to appeal against the decision.

During these periods you are covered by 3c and 3d of the Immigration law.

Thanks..but in case an application is rejected as invalid there will be no appeal rights then, correct? So say if an applicant applies by post a day before his visa expires...and gets to know about rejection of application as invalid after 28 days (assuming candidate hasnt got bio inv letter during this period)what happens then?

You generally get a rejection without getting Biometrics done only if the payment doesn't go through. I can't think of any other possibility.

You have 28 days from the decision date and not the application date to make an appeal or re-apply.

If an application is rejected as invalid and the applicant's leave has expired in the meantime, the applicant will be treated as an overstayer. It is the case that a further application can be be made but the application will be treated as out of time and the applicant will overstay until the application is granted. In the event that the application is refused, it would not attract a right of appeal as the application will have been submitted out of time and the applicant will more than likely have overstayed for more than 28 days due to the processing times.

Payment is the main reason why applications are rejected as invalid, but there are others, for example, photos do not meet guidance, mandatory sections of the form not completed (which could just mean a question missed) form not signed, old version of form submitted etc.

If there has been a significant delay in returning the application as invalid causing the applicant to become an overstayer there may be grounds to challenge the UKBA.

However I must say that I think this thread has run its course - the delays we are talking about are not really very significant, and at the moment we are not talking about a specific case where the application has been rejected as invalid - it is just speculation in general which I do not think is helpful.
