Visa status change before ILR

Post by ilrstatus » Wed Feb 08, 2012 10:46 pm

Hi,

I am on an Tier 1 visa right now and will be completing 5 years in October.

AS I want to take a new mortgage i need at least 2 years on my visa so i am planning to go on a spouse visa (My husband has already got an ILR). We have been married 4 years but we never found the need to change the visa as we both were on our own individual Tier1.

I wanted to know if i will be able to apply for ILR in October ?
Will changing the visa status mean that i will have to remain on spouse visa for 2 years before i can apply for ILR.

Any advise will be appreciated.

Thanks

yes, switching to spouse of a settled person will require you to wait a further two years before applying for ILR.

In your case, its best to wait until October and get your ILR instead.
