Ineligible for OCI if Indian Passport Holder born in UK?

Post by SpokenHands » Thu Feb 09, 2012 11:46 am

My son [currently an Indian passport holder, but born in the UK] is currently applying for MN1 / naturalisation and once this is granted, and thereafter when he receives his new passport; he will need to make travel arrangements should he wish to travel to India.

At that stage, should we apply for PIO or OCI card?
Our preference is the OCI card but it does appear from the criteria set out on the HCIL website that he is ineligible because he was born overseas [in UK].

Any advice is much appreciated

He is eligible if one or boh parents are legible for OCI

From the FAQ on OCI here, it is evident in response 32 that my minor son born in the uk is eligible for OCI as one or both of his parents are eligible for OCI.
