MN1 application for daughter when out of UK 90+ days

Hi Mods,

Can you please let me know if following situation will be an issue?

My daughter was born in UK in 2010 when I had tier1 visa. Subsequently in mid-year 2011 we successfully completed my family's ILR application. Although my daughter, now, eligible for naturalisation I was not able to apply for the same so she continued to have ILR status.

Now she has travelled to home country to stay with grand parents and for some reason likely to stay there beyond 90 days (probably will return back within 100-110 days). Will this create a problem when we apply for naturalisation later this year.

I have an option to get her back before 90 days but would be very difficult and ideally would like to get her back a little later unless there may be issues with our/her naturalisation application.

Any suggestion/guildelines would help me much.

Children don't apply for naturalisation but for registration (same outcome, simpler requirements).

There are no residential requirements for UK born children applying for registration as BC. The only requirement is that one of the parents is granted ILR and that the application is made before the child is 18. That's all.

You can apply for your child registration once she is back in the UK. She doesn't need to apply together with you (she became eligible once you were granted ILR).

Many thanks for the prompt response and for the explanation. Just one more query which will clear all my doubts. Does this condition ("There are no residential requirements for UK born children applying for registration as BC") continue to apply even when she currently has ILR visa.

Basically what I meant is that although originally entitled for registration (given her birth in UK and her parents getting ILR later), will the same entitlement continue even after she also got ILR stamped?

Just want to make sure that I have stated my case clear for seniorforum members to guide.. and that I dont land in a situation where I regret later of not making the right call and have issues at the time of registering her later.

Her immigration status has no affect on her entitlement. In fact, you could have skipped the ILR application for her if she did not have to travel soon after the ILR.
