Hi,

I have recently arrived back to the UK, this time on EEA family permit. I'm graduated here and now looking for professional job but one thing always negative for me is that I only have six months of family permit.

So I'm planning to apply for residence card. I want to find out one very important thing;

Do you get shorter validity residence permit if your family member of EEA student residing in the UK?

My wife is student and She is planning to work part-time as well. So what would be the best way to do for residence permit application. Shall I apply on my wife's student background? or as a job seeker? if I apply on a basis that she is job seeker then what evidence would I require to present?

It will be valid for 5 years. It doesn't matter if she exercise treaty rights as a student. If she is a student now, I would apply based on that. She will need CSI to cover both of you (i believe she alreasy took CSI for herself when you applied for the Family Permit).

A residence card can be issued for a shorter duration if the expressed intention is to reside for less than five years. Example, one wants to work in the UK until the end of the Olympics and go home. Otherwise five years.

Yes I got EEA family permit because my wife is exercising treaty rights as a student. Yes she has CSI currently. So is there a question in EEA 2 application form that how long you intend to live in the UK?.or I should write a cover letter?.

I'm actually very confused whether I should apply residence card now or later. I lost one month of duration because I had to sort out things before leaving Dubai. Now I have time left till end of May 2012. I need a job asap and I'm confused if apply for residence card now then how will I get job without having a passport with me. I know I will get COA. I have full UK driving license so would that work to show as an ID along with COA?

I'm very sorry for too many concerns but they are obvious as we have a child and my wife is full time student so she don't have any access to any of the benefits in worst case scenario as per my knowledge. She got refused recently for child benefit even our daughter was born in the UK. I look forward for best suggestions.

You can ask for your passport back once you get the CoA. It will not affect your application. It means that you will be without a passport for several weeks. You can time it when you think this would be the best but I would recommend apply now than later. You can take a photocopy of your passport to show employer (if they require it) and once you got CoA, they can also call the HO employer helpline to verify your eligibility.

Try to get a certified copy of your passport and the EEA family permit at your consulate before sending it off to the UKBA.

Adnan, how long do you intend to live in the UK? Just answer the question. Nobody can predict the future. If your plans are for the foreseeable future then state that. If your wife expects to work in the UK post study then you don't intend leaving.

After application, you should have a COA after about two weeks. This would be accepted by an employer. Your family permit is valid for UK entry until it expires. Having a residence card is more useful. It really depends on your choice and travel plans. If you don't intent to travel, just apply and get it over with.
