ILR - 90 day rule

Guys,

Could someone more knowledgeable help me ascertain when to apply for ILR? I have rung the UKBA office, but keep getting different outcomes to the same question.

HSMP Visa Awarded: 17th Nov 2007
Arrived UK: 16th Jan 2008
Dependants arrived UK: 16th Feb 2008
Extension granted until: 14th Dec 2012

As I prepare to apply for ILR later this year, please when is the earliest I can apply? If I have to go by the 90-day rule, it would have to be 20th Oct 2012.

As per the UKBA revised guidance, if you entered UK within 90 days of getting HSMP, you can apply 28 before your HSMP stamp date.

But in your case it falls on a weekend (20th Oct 2012), so the earliest you can apply is 22nd Oct 2012.

My family arrived 16th Feb 2008, and we have not been privileged to leave the UK ever since. I understand dependants only have to have been here for 2 years to apply for ILR. In our case, today marks their 4th anniversary.

Can we all apply for the ILR at the same time on the 22nd Oct 2012?

You can all apply for ILR at the same time as your family has been with you for over 2 years in UK.

Also if any of your kids was born in UK, you don’t need to include that child in your ILR and can apply for British Naturalization for him/her directly after you get your own ILR.

But if a child is not born in UK, he/she has to be added in your ILR application.
