I HAVE APPLIED FOR HSMP UNDER 28 FROM INDIA,AHMEDABAD

APPLICATION SENT ON 14TH JULY VIA DHL,
APPLICATION RECEIVED AT HOME OFFICE ON 18TH JULY.
PAYMENT CLEARED ON 27TH JULY
REF. NO RECEIVED BY E-MAIL ON 9TH AUGUST.
DECISION MADE ON 16TH AUGUST -- CONFIRMED OVER PHONE.

Document received at my PO Box Today: 23/08/2006.

Net days for File Processing: 35 Days

I got 55 points out of 95 claimed.

Following is the description given in refusal letter.

Academic Achievement - 15 points awarded.

Work Experience - 35 points awarded.- CLAIMED 50
We were not satisfied that sufficient evidence was provided to demonstrate that your previous work experience involved 1 year specialist or senior level work experience.
The HSMP guidance state that senior level work experience would normally be a role at board level within a small company where there would be evidence of your active involvement in the day to day running of the company. For a larger company, the expectation is that evidence is provided to demonstrate that you have ultimate control a sector of the business such as Department Head or leader of a project management
team. A specialist position is one that would require a very high level of technical or artistic expertise. Therefore points have been awarded accordingly for graduate level work experience.

Achievement in Chosen Field - 0 points awarded.
Points not claimed.

Skilled Partner. - 0 points awarded. [ CLAIMED 10 POINTS ]

The evidence supplied did not support your claim for 10 points for this section. The HSMP guidance states that evidence is required to demonstrate that the applicant's spouse is educated to degree level or employed in a graduate level post. Your application form states that your spouse has been employed at graduate level. The evidence to support this claim must be, 'original employer references on letter headed
paper. They should include the start and end dates of each position held during the employment together with the job title and a full description of the duties and responsibilities held'. We were not satisfied that the reference provided demonstrated that your spouse is currently working in a post that necessarily requires a degree level qualification.

Insufficient supporting evidence was provided for the points to be awarded. The HSMP guidance states that the applicant must supply 3 pieces of evidence to demonstrate that they and their long term partner have been living in a relationship of either marriage, civil partnership, or a relationship akin to marriage, that has subsisted for at least the last
2 years. The evidence must confirm that you have been living together at the same address for this 2 year period. (Married couples should provide their marriage certificate as one of the pieces of evidence. Civil partners should provide their civil partnership document. The guidance notes give a list of suggested documents. The evidence provided with the application does not demonstrate that these requirements have been met. No forms of correspondence to cover the time period of 2004,2005 and 2006 was
submitted as evidence. Therefore we were unable to award points for this section.

What Should I Do now ?????
i am 10 points shortage only ""

TRY FOR additonal 15 points for Work EXP. [ 50 points ]
TRY FOR 15 points of achievement which they have missed ??
TRY FOR 10 points of Spouce.

One another problem for Spouce is that i got married on April , 2006. so how i could get 2 years relationship evidances.

Anyways, in my opinion review is not an option you should look at. I am basing my opinion on the facts you have outlined and what I understand from those facts:-
1. Work Experience - It is essentially up to you to provide "adequate" evidence for a caseworker to consider any part of your work experience as a senior level / specialist level. It all boils down to the content of your reference letters. I am not sure anyone on this forum can comment whether you have senior / specialist level experience or not. Only you know it and you have to justify it somehow to the caseworker.
2. Achievement in chosen field - One of the most difficult to score in, unless you have clear evidence to categorically prove that your achievents have / or have the potential to benefit the community at large or sector / industry for which you are claiming significant achievement points. I am not sure what type of evidences you provided to support your claim but casworkers look for precise and specific evidences here before they award any points in this category.
3. Spouse - As you have said yourself that you got married in 2006. There is no way you can claim points in this category, unless you can show that you were staying with your partner in the same house since the last 2 years :wink: !!

Hi,

Sorry about this. It happens. I think you chose all criteria that are subjective to the caseworker's decision.

I think you have to let us know what roles you claimed for the work experience criteria.

Also, let's know what your background is. Can I suggest to you also to tell us why you didn't claim any point in earning criteria. I believe if you let us into this info, we can advise you further.
