Exceeded 90 & 180 days. Advice please.

Hi All,

My friend's situation is as follows. Any kind guidance regarding the options available to him would be deeply appreciated.

Background:

1. Work Permit + Tier 1 over 5 years

2. Single business visit for 126 days in 2010 (Paid in the UK)

3. Total absences out of the UK in 5 yrs - 253 days

4. Became eligible for ILR in January 2012

5. Applied for ILR through solicitor for same day service
(Submitted all mandatory documentation. Documentation in support
of absences included employer letter for business visit,
rental agreements& payments and council tax payments)

6. ILR application retained for further enquiries

7. Tier 1 Visa expired after the submission of ILR application
and currently staying in the UK under Section 3C. Still waiting for decision

Queries

1. Has anyone received ILR after enquiries in similar circumstances in 2012

2. If the ILR is refused, would it be possible to apply for
Tier 1 extension immediately as he is currently staying
under Section 3C

2. If the ILR is refused with Right to Appeal, how long does the
appeal process normally take on an average if he decides to go
for appeal

3. If the ILR is refused without Right to Appeal, would it be possible
to apply for judicial review and continue to stay in the country until
the process is completed. How long does the judicial review
normally take on an average

My friend works for a UK company and submitted all the required documentation to demonstrate his ties to the UK during the 5 yr period.

i also want to answer of your queries. you can tell your employer that UKBA might take reference so please be ready and let them aware of this... on this stage i can recommend this only.
