Dear members of Immigration board
I am back with a very important question about public found.
My husband British born and my son British passport, I have a spouse visa.
Can we claim Child benefit and Tax credits ? are they taken into account like public funds?
I do understand that my husband can not claim on his own only like couple, but I dont want to claim nothing that can bring me into trouble.

Yes you can claim both without any problems as a joint couple

yes you can claim as a couple. Child benefits is given to every child born in the uk and is not classed a means tested benefit.

Child benefits are not paid to every child born in the UK.

My son has British passport but he was born outside the UK, does it makes any difference ?
But the child benefitt office ask you for birth certificate and passport for the child and then give you the answer about your child benefit amount?
Can they make mistakes ?

it is not the child who is eligible but the parent. if your husband is British he should claim the child benefit in his name. The CTC/WTC should be claimed in joint names.
