ILR - Eligibility Date

Hi all

Need some advise on the eligibility for my ILR application.

I had got Approval for my initial HSMP/Tier 1 visa in AUG 2006.
Got entry clearance (Stamped Tier-1 visa) on 11/02/2007(valid for 2 years)

Entered UK after 7 months - 2 Sep 2007

Got First Extension after 2 yrs in Sep 2009 which is valid until 2nd Sep 2012.

When can I apply for ILR at the earliest considering there is a grace period that caseworker can consider (upto 90 days from the date of initial entry clearance to calculate 5 year period)?

Also, i havnt got any stamping on my passport for date of entry, but my existing leave is valid until Sep 3rd 2012. Would it be possible for me to apply for ILR now - Works out 5 years based on my initial entry clearance date (11th Feb 2007). Appreciate your help..

I might perhaps be required to do some extensive business travelling in the next few months which might invoke ''max 90 days outside UK in last 12 months clause'' by September 2012.
So when is the best time for me to apply ILR?

Hi Vishal

Although your initial visa was issued on 11/02/2007 you have entered UK on 02/09/2007, so calculating 5-years from the date of entry, you can apply for ILR 28 days before 02/09/2012.

Even if there is no entry stamp on your passport, they would have swiped your front page of your passport which records your date of entry in their IRIS system and they can find out when you have entered UK.

With regards to the grace period that only applies (I think) if at all you have entered UK within 90 days of initial visa to UK.

It is better to mention the correct day of your entry to UK.

just curious - your initial visa was valid for 2 years i.e until 11/2/2009 and you got your extension after 2 years in September 2009 - what was your visa status between this period?
