can I extend early in my case?

hi everyone, I applied for tier1 general within 7 days of epiry in early 2011however, the visa was refusd because of unacceptable documt submitted.produced the acceptable doc in appeal and visa was granted the appeal took 3months now my qustion is although the date my visa was granted is now 3 month later, because of the apppeal when should I apply for my extensuon to qualify for the 5 years ILR? Shouls I go by the day my visa should hav been granted if there was no appeal or the date of epiry of my visa?
