Hello,

I'm really desperate for help in our case. My girlfriend is Japanese and her visa expired a few days ago, so she had to go back to Japan. I'm a Spanish national living in the UK since July 2011 with a full time job.

We have been together for around 6 months and we love each other as we have a really intense love story, and I would like to bring her back so we could live together and get married at some point. I have been reading about EEA2, and any option so she could come back but it seems that the minimum would be 2 years just to have a chance to apply.

She has been studying and working in the UK for the past years (2005-2008) and then 2010 to the past week, but her company didn't get the chance to renew her visa.

What are the chances for us to be living together in the UK/Europe?

Also, what would be for us the easiest way to be together in any country where we could both get a visa so we can stay together in case there wasn't an option for the Uk?

I just need some hope, and a lot of help or any ideas....

I'm not an expert in this subject but since nobody replied to your question,

IMHO Your best bet is to get married to her and apply for EEA2. You must exercise your treaty rights here (Which you can cause you are working) and you must prove UKBA your relationship and marriage is genuine.

But if you go to a country like Norway you can sponsor her as a Fiancé.

But I think you have to live and work in Norway to be eligible.

Option 1:Your girlfriend has overstayed her visa hence The only problem she may encounter is if she have to return to the UK in future - a strict immigration official might make her previous overstaying an issue but again she can always apply for visa to come to the UK in Japan before she leaves - many official would consider an overstaying by few days as not major issue, she needs to make sure that she have a good reason for her overstaying such as she was recovering from an illness etc... option 2: that you can join her there in Japan and get married together since you haven't been partners over 2 years and apply for a family permit trough the British high commission in Japan they will issue her with 6 months permit once here in the UK she can apply for residence permit EEA2 and get 5 years residence... Option 3: she can marry you and live with you in Spain she will be able to opt for Spanish citizenship after having legally resided in Spain for one year. To obtain residency and The process to obtain citizenship through a civil registry in Spain, normally takes a couple of years. It depends on how busy the corresponding civil registry is.
