need to claim points ( extension ) please help!

need to claim points ( extension ) please help!

i have download the form for extension and it has come to my attention that there is a confusion regarding my age and earnings ,i applied on 16 may 2010 for first initial application and was granted visa on 16th June 2010,now when i see that the form there is statement written by bia about the age and earnings they have written in the form ,i.e:

1. Please tick the relevant box to confirm the points claimed by the applicant on the basis of his/her age at the date of application for the first grant of leave in the category.Applications for leave to remain where the applicant has, or has had, leave as a Highly Skilled Migrant, as a Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General) Migrant under the Rules in place before 6 April 2010, and has not been granted leave in any categories other than these since 6 April 2010.

Under 28 years of age 20 points
28 or 29 years of age 10 points
30 or 31 years of age 5 points

All other applications for leave to remain

Under 30 years of age 20 points
30 to 34 years of age 10 points
35 to 39 years of age 5 points


there is also earning issue as you seen ith e form i.E:

Please confirm points being claimed for total earnings Applications for leave to remain where the applicant has, or has had, leave as a Highly
Skilled Migrant, as a Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General) Migrant under the Rules in place before 6 April 2010, and has not been granted leave in any categories other than these since 6 April 2010.

£40,000+ 45 points £23,000 - £25,999 20 points
£35,000 - £39,999 40 points £20,000 - £22,999 15 points
£32,000 - £34,999 35 points £18,000 - £19,999* 10 points
£29,000 - £31,999 30 points £16,000 - £17,999* 5 points
£26,000 - £28,999 25 points

* An applicant cannot claim points for previous earnings of less than £20,000 if:
a) his/her last grant of entry clearance was as a Tier 1 (General) Migrant under the rules in place between 31 March
2009 and 5 April 2010, or
b) (i) he/she has had leave to remain as a Tier 1 (General) Migrant under the rules in place between 31 March 2009
and 5 April 2010, and
(ii) his/her previous entry clearance, leave to enter or leave to remain before that leave was not as a Highly Skilled Migrant, as a Writer, Composer or Artist, as a Self-employed Lawyer, or as a Tier 1 (General) Migrant.

All other applications for leave to remain

£150,000+ 80 points £40,000 - £49,999 25 points
£75,000 - £149,999 45 points £35,000 - £39,999 20 points
£65,000 - £74,999 40 points £30,000 - £34,999 15 points
£55,000 - £64,999 35 points £25,000 - £29,999 5 points
£50,000 - £54,999 30 points

i do not know understand that what exactly home office mean is ? please help me ! because if you guys reed the form it will effect most of the people cos then we have to also claim 30 points for earnings as well according to above paragraph .
i showed 35k when i applied for my first leave now it looks to me that i have to show 50k please you also reed the form and give us guidenace,thanks

As you applied after April 2010, you need to select the second para options. You need to select your age at the time when you first applied.

Same applies for the earning section as well. Choose from the second option.

Hi ,
I have same confusion which one should I choose.
I got my intiial VISA under HSMP on 12th Nov 2007.
First extension on 12th Nov. 2009
Second extension applying now with in a week.
Beause I 5 months short for ILR. So I need to go for second extension.
As per your reply I think I have to choose first option for both questions.
Please clarify
