ILR - Completion of 5 years

My Initial Tier-1 visa was approved from 03-July-2008 till 03-July-2011, while I’m in UK

Applied for extension on 06-June-2011.(face to face)

On the biometric card
I have got date of issue: 06-June-2011 and valid till: 06-June-2013
instead of date of issue: 06-june-2011 and valid till: 03-July-2013 .

my concern is i have got wrong valid till date , what should i be doing ?

I have called HO and advisor said visa is issued from date of application , if thats the case all of my friends has got extension valid till from the date of expiry ...

For ILR as i can apply 28 days before my inital visa expires and qualified for 4 years 11 months stay - i will be left out to apply on the day of expiry of visa i.e on 6th of june -2103

Can moderators or senior members suggest me

Mahit,

It is normal for UKBA to issue the extension visa from the date of the approval (06-Jun-11) and a corresponding expiry date (06-Jun-13).

It normally does not start from the end of the previous visa (03-Jul-11) as you may expect.

And im falling short for my 5 years stay and for my ILR ... What is the solution now for this ?????

You can apply for ILR 28 days before you complete 5 years in UK i.e. on 5th June 2013

In that case I’m left out with 2 days for my ILR before my current visa is expiring..

Can i challenge caseworker through a Lawyer, so that I get my visa expiry date given ending till 03-07-2013 ?

I don't see how you can - you were given leave from the date of decision which is standard.

Push: I would get solicitor help asap because your time is an essence here. Tip : Till HO has your passport you can't go out of the country.

The exension should have been 2 years from the date your tier 1 expires (02 July 2013)

My hsmp was issued on 02 November 2007 to 01 November 2009

and when I applied for extension on 08 October 2009, my tier 1 extension was issued from 08 October 2009 to 01 November 2012

I have the same issue as above. My dates are

Initial Tier-1 visa from 17-July-2008 till 16-July-2011
PEO extension in the UK - 06-June-2011 valid till 06-June-2013

They have correctly used the application date as the visa's valid from date as it says so in the Tier 1 general guidance document

However, the issue is that the same document advises that applications for Tier 1 extensions should be made at least a month BUT not significantly higher before current leave expires. (what's "significantly"?)

For ILR, HO then says to apply within 28 days of expiry.

As a result of this confusion, my total validity under Tier 1 will be 4yrs 10 mths 21 days.

I suspect that if these facts of their confusing statements are presented the ILR will be granted (it might be different if you applied like 4 or more months before cureent expiry date).

I don't think they'll refuse your application and dont think there's a need for further extension

Is this just wishful thinking? Somebody correct me if I'm wrong

Did you apply by post? that might be why. also note that you applied within one month from the expiry date

Yes by post, but I don't see why face to face should be different as long as you apply within the 28 days limit?

Problem over here is i have got just one-day left before my visa is expiring , any rejection/issue in first instance of my ILR application i have no choice to re-apply isi'it ???

and getting the appointment on 5th or 6th of june 2013 chances are very lean

so pls suggest :( :( , can i approach any lawyer so tht i can request HO to get my dates corrected on my bio-metric ?

Yes, provided you secure an appointment for the 5th and if your ILR rejected on that day, you will only have 24 hours to re-apply for ILR or submit a Tier 1 extension.

Or if you really want to be on the safe side, don't go for ILR - get a Tier 1 extension in June 2013 and apply for ILR after you complete the full 5 years.

Still I cannot see why a PEO application should give any less validity period for an extension than a postal application?
