Will I be affected by £35k if I switch to Tier 2 ?

Post by inzogbiya » Wed Mar 14, 2012 12:25 am

Hi

I'm currently on a work permit which expires three months before I can apply for ILR (Entry clearance expires Aug 2013 but I'll complete 5 years in UK on Nov 2013). This to my understanding will require an extension, which I guess will involve a switch to Tier 2 prior to my ILR application?

If this is the case and I needed to switch to Tier 2, will the new £35K be applicable to me as the switch will happen after 6 April 2011??

... OR the £35k is only applicable to ILR applications after 6 April 2016, eventhough you'd be on Tier 2 after Apr 2011?

Any clarifications greatly appreciated !

Many thanks

Not likely. You will be able to apply for ilr before 2016 when they start the 35k rule. Also switching from work permit to tier 2 is treated in a special way.
