Post by hpat » Thu Mar 29, 2012 4:10 pm

My child was born 10 day before I got ILR. Can I ragister him as British citizen and does he require Indian passport?

If he was born in the UK, then you can apply for registration as a BC using form MN1.
There is no requirement for the child to have a passport when applying.

Confused in the question in MN1 form

Post by hpat » Tue Apr 10, 2012 1:03 pm

There is one question in the MN1 form asking the nationality for the child.
If I don't take child's indian passport then child will not have any nationality and guide for MN1 reads
"Enter the child's present nationality. If an application is being made on the basis that
the child is stateless (i.e. he or she does not have the nationality of any country), an
application should be made on form S2 or S3."

Not sure if indian passport is required for the child?
Have anyone come across this situation?
Any help would be appriciated..

Passport is travel document NOT nationality document. Your child still has same nationality as yours at present. Although if child already has passport, you must send with application otherwise no need.

Indian passport or registration NOT needed for MN1. I've registered my one year old recently and got approval without any certificates. You just need to send birth certificates and parents ILR. I would recommend NCS as you don't need to send originals.

QUERY reg child BC ( born at UK)

Post by apsaps » Sun Apr 22, 2012 3:24 pm

I am confused for below scenario , please someone advise /help.

Current visa : Tier 1
Dependent 1 : Wife and
Dependent 2 : Son ( Born at UK)

1.) Can Myself and wife ONLY apply for ILR is valid scenario?

2.) As soon as we get ILR , then apply for BC for son .

Over here if we get ILR at the point of time also child remains in Tier 1 Dependent visa - will this be OK ...I was thinking than child T1 Dedendent visa automatically becomes invalid after I get ILR.

In this case what visa status will child have ?

Thanks
APS

The child will not have a valid visa. However, when applying for BC for a UK born child, there is no need to have a valid visa. If the child will travel after your ILR, better to include him in your ILR so he can re-enter the UK.

See Q3 in FAQ - most common questions - children.
