HSMP (Tier1) extension refused then transitional arrangement

Dear Team Member,

If nayone have knowledge then post your view that if HSMP(Tier1) visa will be refused due to eraning or long perid out stay form UK then,tier1 visa holder are permitted ofr work permit with whom they are working form last 1 year.

Is that true or any one know about that for transitional arrangement?

please provide your view.

thnaks for rpely and sorry from my side that I could not able explain properly.

I want to say that, if a person in UK under HSMP+tier1 and in 2013 his/her visa will be expired.now when he/she will apply for extension and due to long period stay out of UK (mean not continue 4 years stay in UK) and also not score 75 points for earning,then he/she will get extension or not?and if not then what will be other way to extend visa in other category?

As per my knowledge a person can apply for work permit where he/she is working currently and if a person is covering under HSMP judicial review then may be he/she will not required procedure work work permit permission.his/her employer can apply for work permit

is it true or may be some different way?then please guide.

I think what you are saying is that if you have had a combination of HSMP and Tier 1 visas but aren't eligible for ILR due to absences, can you extend your Tier 1 again? And if so, on what conditions? And if you don't meet the Tier 1 extension criteria, what are your other options?

Is that your question?

If so, I think the answer is you can (currently) extend as many times as you want provided you meet the extension criteria. The extension criteria (e.g. points) are different depending when you received your Tier 1, whether you are HSMP judicial review, ... And you can refer to the guidance notes for the criteria that apply to you.

If you don't meet the extension criteria, you won't get an extension. If you are eligible for another visa you can apply for it. I am not familiar with the rules for getting a work permit so someone else may be able to advise.

Stay outside UK should not be a problem if you get the required points for extension. If you don't get the required points for extension, you cannot extend under Tier 1.

I am not sure if you could get a work permit for the employer, you are working currently. In any case, switching visa category would mean that you would have to return to your home country and then apply for Tier 2. If you get a fresh Tier 2, you would not be able to convert to ILR.

Thanks a lots for your reply...........now i may be think in right diretcion...
just one more help is if out of 4 years tier1 visa if i stay only total 1 year in uk and its 3-4 months every year and if i score enough point forextension then is their possibility for extension?

For the extension, you have to be in UK physically.

Staying in UK is not a requirement at all for your extension. You just need to prove that you get the necessary points and the earnings that you claim from other countries will not have the uplift ratio that you might have had the first time.

As per my knowledge,hsmp judicial reviw affected+ Tier1 visa holders,if they can not get point for extension,thay can apply for permit with whom they are working and for that employer do not need to do process of work pemit but they can directly apply for people who are falling in JR.

Please share your view and knowledge.
